Terms and Conditions of Use

1. IDENTIFICATION DATA

You are visiting the institutional website (hereinafter, the “Website”), owned by the NATIONAL FEDERATION OF SAVINGS AND CREDIT COOPERATIVES OF PERU (hereinafter, FENACREP), identified with R.U.C. No. 20101274919, with registered address at Jr. Máximo Abril No. 542, Jesús María district, province and department of Lima.

2. USER ACCESS AND ACCEPTANCE

These Terms and Conditions govern the access to and use by the User of the services and facilities offered by the Website. The status of “User” is acquired merely by browsing and/or using the Website.

The User may access and browse the Website freely without the need for prior registration.

Likewise, access to and navigation of the Website by the User implies full and unconditional acceptance of all the provisions contained in these Terms and Conditions.

3. MODIFICATION OF THE TERMS AND CONDITIONS

FENACREP expressly reserves the right to modify, update, or expand these Terms and Conditions at any time. Any changes will be published immediately, and it is the User’s responsibility to review the Terms and Conditions in force at the time of navigation.

If the User does not agree with the aforementioned modifications, they may choose not to use the services offered by FENACREP through the Website.

4. SERVICES OFFERED BY THE WEBSITE

The Website provides a platform through which Users may access general information, services, and/or news related to FENACREP, its affiliated COOPAC, and/or the savings and credit cooperative system.

Users acknowledge that they have voluntarily provided their personal data, in accordance with the Website’s Privacy Policy.

5. USE OF THE WEBSITE

The User undertakes to use the Website in accordance with the Law, these Terms and Conditions, morality, good customs, and public order. In this regard, use of the Website shall comply with the following guidelines:

  • The User agrees not to use the Website for unlawful purposes or effects contrary to these Terms and Conditions, harmful to the rights or interests of third parties, or that may damage, disable, or impair the platform or prevent the normal use of the Website by other Users.
  • The User expressly agrees not to destroy, alter, disable, or otherwise damage data, programs, electronic documents, or other elements contained on the Website.
  • The User agrees not to hinder access by other Users through excessive consumption of computing resources, nor to perform actions that may damage, interrupt, or cause errors in the systems.
  • The User agrees not to attempt to access or test the vulnerability of any system or network of the Website, nor to breach security or authentication measures.
  • The User agrees to make appropriate use of the content offered on the Website and not to use it to engage in unlawful activities or to publish any type of illegal content.
  • The User agrees not to use the Website, by way of example but not limitation, to send mass emails (spam) or emails containing threatening, abusive, hostile, offensive, defamatory, vulgar, obscene, or insulting content, nor to use illegal, abusive, threatening, obscene, vulgar, or racist language, or provide links to sites containing illegal material or content that may harm or damage another User’s network or computer.

FENACREP reserves the right to determine, at its sole discretion, when a violation of any of the provisions set forth herein has occurred, as well as the right to remove such content from the Website.

In the event that a User breaches the provisions of this section, FENACREP may take one of the following actions, depending on the severity or recurrence of the violation: 1) Warning to the User; 2) Civil or criminal liability actions.

6. INTELLECTUAL PROPERTY

All intellectual property rights of the Website, including its content and designs, belong to FENACREP.

The reproduction, distribution, transformation, public communication, making available, or any other form of use, in whole or in part, of the Website’s content, in any medium and by any technical means, is expressly prohibited without prior authorization from FENACREP, except where such information has been obtained from public sources.

Likewise, the use or reproduction of any registered trademark, name, or logo appearing on the Website without prior written authorization from FENACREP is expressly prohibited, as is the use of the software operating the Website, except as permitted under these Terms and Conditions.

The following practices are also expressly prohibited, by way of example:

  • Displaying a Website page within a window that does not belong to FENACREP through the technique known as “framing,” unless prior written authorization has been obtained from FENACREP.
  • Embedding an image published on the Website on a page not belonging to FENACREP through the technique known as “inline linking,” without prior written authorization from FENACREP.

7. CONTENT GENERATED FROM INFORMATION PROVIDED BY AFFILIATED COOPAC

FENACREP publishes economic information from its affiliated COOPAC as a reference; however, it is not responsible for the accuracy of the financial data provided by such COOPAC. The User is responsible for verifying such information for any intended use.

8. THIRD-PARTY LINKS

In the event that the Website contains links or hyperlinks to other Internet sites, FENACREP declares that it exercises no control over such sites or content and assumes no responsibility for them.

These links are provided solely to inform the User of the existence of other sources of information on a specific topic, and their inclusion does not imply endorsement by FENACREP.

9. LIMITATION OF LIABILITY AND INDEMNITY

Unless otherwise required by applicable mandatory law, use of the Website and all its functionalities is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

FENACREP shall not be liable for damages arising from interference, omissions, interruptions, computer viruses, breakdowns, or disconnections in the operational functioning of the electronic system, or delays or blockages caused by deficiencies or overloads of Internet systems.

Likewise, FENACREP shall not be liable for the quality, usefulness, or suitability of the information provided to the User through the Website.

10. PERSONAL DATA

11. FORCE MAJEURE

FENACREP shall not be liable for any delay, failure, or interruption in the provision of services resulting directly or indirectly from causes beyond its reasonable control, including but not limited to equipment failures, communication line failures, theft, operator errors, severe weather, earthquakes, natural disasters, labor disputes, wars, or governmental restrictions.

12. AUTHORITIES AND LEGAL REQUIREMENTS

FENACREP cooperates with competent authorities and third parties to ensure compliance with laws related to intellectual property rights protection, fraud prevention, consumer protection, and other matters.

FENACREP may disclose the User’s personal information upon request by competent judicial or governmental authorities, when deemed necessary for investigations related to criminal offenses, fraud, piracy, copyright infringement, or other illegal activities.

FENACREP also reserves the right to communicate information about its Users to other Users, entities, or third parties when there are sufficient grounds to believe that a User’s activity may be illegal or harmful, in order to protect the integrity and security of the Website and its Users.

13. NO PARTNERSHIP OR EMPLOYMENT RELATIONSHIP

User participation on the Website does not constitute or create any partnership, agency, mandate, or employment relationship between the User and FENACREP.

14. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by Peruvian law, and any dispute related to their validity, application, or interpretation shall be resolved before the courts of Cercado de Lima.
